1. Introduction
Welcome to SealPup. These Terms of Service ("Terms") govern your use of our website sealpup.com (the "Site") and your purchase of any products from us. By accessing the Site or placing an order, you agree to be bound by these Terms. Please read them carefully.
In these Terms, "we", "us", and "our" refer to SealPup operated by OZKUL, LLC, a company registered in USA. "You" and "your" refer to the user or customer.
2. Eligibility
To place an order with us, you must be at least 18 years old and capable of entering into a legally binding contract. By placing an order, you confirm that you meet these requirements.
3. Products
We sell children's swimming goggles and related swim accessories. We make every effort to display our products and their colours as accurately as possible, but we cannot guarantee that your device's display accurately reflects the actual colour of the product.
All products are subject to availability. We reserve the right to limit quantities, discontinue any product, or change product specifications at any time without notice.
4. Safety Notice
Our products are designed for children but are not a substitute for adult supervision. Children must be supervised by a responsible adult at all times when in or near water. SealPup products are swimming aids and accessories only; they are not life-saving devices and do not prevent drowning. Always follow safe swimming practices.
5. Orders and Contract Formation
When you place an order, you will receive an email acknowledging that we have received it. This acknowledgement does not mean your order has been accepted. A binding contract is formed only when we send you an email confirming that your order has been dispatched.
We reserve the right to refuse or cancel any order at our discretion, including in cases of suspected fraud, pricing errors, or product unavailability. If we cancel an order you have already paid for, we will issue a full refund.
6. Pricing and Payment
All prices are listed in British Pounds (GBP £) and include VAT where applicable. We reserve the right to change prices at any time, but changes will not affect orders already confirmed.
Payment must be made in full at the time of order through the payment methods offered at checkout. By submitting payment information, you confirm that you are authorised to use the payment method.
In the event of an obvious pricing error, we are not obliged to fulfil an order at the incorrect price and will contact you to arrange a corrected order or a full refund.
7. Shipping and Delivery
Delivery times and costs are set out in our [Shipping Policy]. Estimated delivery times are provided in good faith but are not guaranteed. Risk of loss passes to you upon delivery.
8. Returns and Refunds
Our returns and refunds terms, including our 90-Day Happiness Guarantee, are set out in our [Returns & Refunds Policy], which forms part of these Terms. Nothing in these Terms affects your statutory rights as a consumer.
9. Your Consumer Rights (UK)
As a consumer in the United Kingdom, you have legal rights under the Consumer Rights Act 2015 and the Consumer Contracts Regulations 2013, including rights relating to goods that are faulty, not as described, or not fit for purpose, and a right to cancel certain orders. Nothing in these Terms limits or excludes these statutory rights.
10. Intellectual Property
All content on the Site — including the SealPup name, logo, text, graphics, images, and product designs — is our property or licensed to us and is protected by applicable intellectual property laws. You may not copy, reproduce, or use any of our content without our prior written permission.
11. Acceptable Use
You agree not to use the Site for any unlawful purpose, to attempt to gain unauthorised access to our systems, or to interfere with the Site's operation. We reserve the right to restrict or terminate access to anyone who breaches these Terms.
12. Limitation of Liability
To the fullest extent permitted by law, we will not be liable for any indirect, incidental, or consequential losses arising from your use of the Site or our products. Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud, or for any other liability that cannot be excluded under English law.
Our total liability to you for any claim arising out of an order shall not exceed the amount you paid for the relevant product.
